What this policy covers
This policy covers the website etheresoftware.com and the messages you send us through the contact form or by email.
When we work for a client and handle data on its behalf, for example inside its databases or servers, that work is governed by the contract and the data processing agreement signed with that client, not by this policy.
What data we collect
When you use the contact form
- Your name
- Your company, if you add it
- Your email address
- Your phone number, if you add it
- The topic you pick and the message you write
- The language of the page and the address of the page you sent the form from
The form also includes two checks against spam, a hidden field and a timer. They do not identify you and are not stored.
When you email us
Your email address, the name shown in your email, the content of the message and any attachments.
When you browse the site
Like any website, ours receives some technical data with each request, such as your IP address, browser type, the page requested and the date and time. Cloudflare, which hosts and protects the site, processes this data to deliver the pages and to keep the site secure. We do not use it to identify you or to build profiles. The site has no analytics, no advertising and no social media trackers.
What we ask you not to send
Please do not send us sensitive data, such as health information, or passwords and access keys, through the form or by email. If we need access to your systems, we agree a safe method with you.
Why we use it and on what legal basis
Where the EU General Data Protection Regulation (GDPR) applies, we use your data for these purposes and on these legal bases.
| Purpose | Data | Legal basis |
|---|---|---|
| Replying to your request and, if you ask, preparing a proposal or a contract | Form and email data | Steps taken at your request before a contract, Art. 6(1)(b) GDPR |
| Following up our conversation and keeping a record of our correspondence | Form and email data | Our legitimate interest in managing business contacts, Art. 6(1)(f) GDPR |
| Keeping the site and the form secure, and blocking spam and abuse | Technical data | Our legitimate interest in protecting the site, Art. 6(1)(f) GDPR |
The checkbox in the form confirms that you have read this policy. We do not use your data for newsletters, advertising or profiling, and we make no automated decisions about you.
Where we rely on our legitimate interest, you can object at any time, as explained under Your rights.
How long we keep it
- Messages from the form and emails. Up to 24 months from our last contact, then deleted.
- If a contract follows. The data needed for it is kept for the length of the contract, and afterwards for as long as the law requires, for example for tax and accounting records.
- Technical data. Processed by Cloudflare and kept for a short time under Cloudflare’s own rules.
Who receives your data
Only the people on our team who need it to reply to you. We also use a few service providers that process data on our behalf, under contract.
| Provider | What it does | Where |
|---|---|---|
| Cloudflare, Inc. | Hosts the website, delivers the pages and protects them from attacks and bots | United States, with a global network |
| SMTP.com | Delivers the messages from the contact form to our mailbox | United States |
| Zoho | Hosts our mailbox, staff@etheresoftware.com, where messages are kept | Zoho data centers |
We may also share data with professional advisers bound by confidentiality, or with public authorities when the law requires it. We do not sell your personal data and we do not share it for advertising.
Transfers to the United States
Ethere Inc. is based in the United States, so the data you send us is processed in the US. Some of our providers also process data in the US or in other countries.
Where the GDPR requires it, these transfers rely on appropriate safeguards. These are the Standard Contractual Clauses approved by the European Commission or, where the recipient is certified, the EU-U.S. Data Privacy Framework. You can ask us for more information about these safeguards by email.
How we protect it
The site works only over encrypted connections (HTTPS). Messages from the form go straight to our mailbox and are not stored in a database on the website. Access is limited to the people who need it, and we choose providers with solid security practices.
No system is perfectly safe. If a data breach ever affected your data, we would inform you and the authorities as the law requires.
Your rights
Under the GDPR you can ask us to:
- Access the data we hold about you and get a copy
- Correct data that is wrong or incomplete
- Delete your data
- Restrict how we use it
- Receive it in a common, machine-readable format (portability)
- Stop using it where we rely on our legitimate interest (objection)
To use these rights, write to staff@etheresoftware.com. It is free. We reply within the time set by law, normally one month, and we may first ask you to confirm your identity.
Complaints
If you think we have not handled your data properly, you can lodge a complaint with the data protection authority of the EU country where you live, where you work or where the issue happened. In Italy this is the Garante per la protezione dei dati personali (garanteprivacy.it).
We would be glad to hear from you first, so we can try to put things right.
US residents and California
We do not sell or share personal information, as the California Consumer Privacy Act (CCPA, as amended by the CPRA) defines those terms. We do not use sensitive personal information to infer anything about you.
The categories we may collect are the ones described above. They are identifiers (name, email address, phone number), professional information (your company), the content of your messages and technical internet data. We collect them directly from you and from your browser, for the purposes listed in this policy.
If you live in California, you can ask to know what personal information we hold about you, to correct it and to delete it, and you will not be treated differently for asking. Residents of other US states with similar privacy laws have comparable rights. Write to staff@etheresoftware.com. You can also act through an authorized agent. We will verify your request before acting on it.
Children
This site is meant for businesses. It is not directed at children, and we do not knowingly collect data from anyone under 16.
Cookies
The site sets no cookies of its own and uses no analytics or advertising. Cloudflare may set a strictly necessary security cookie. The details are in the cookie policy.
Changes to this policy
We may update this policy when our services, our providers or the law change. The date at the top always shows the current version. If a change is significant, we will say so clearly on this page.
